Assuming the trial goes forward, and it certainly looks thay way, then as long as we get to ask the TI and Qualcomm witnesses all the questions we want, we should be OK. If I understand the tech correctly, it will be difficult, if not impossible, to provide non-infringing answers to our pointed questions.
There are two big assumptions in that statement.
The trial. I can't imagine the ALJ allowing both sides to put this much into trial preperation and not let it go forward at this point.
The questioning of the witnesses. The ALJ knows what it is we want them to testify about. It is contained in one of the filing with respect to the TI subpeonea. If it is the ALJ's intent not to allow us to ask those questions, the trial is a waste of everyone's time.
Hence, I am hopeful we will get what we need from those witnesses. And for the most part, all else that is going on is just noise. At least from my perspective.
