called for , PTSC would have 1.75% (approx) less in revenue recovery from the MMP receipts.
It is true that PTSC was not a defendent and it is also true that Brown cannot force PTSC to pay.
The question becomes .... 1) can TPL come back against PTSC to recover those improper additional amounts, or ... 2) will PTSC step forward and offer to pay their share of overage, or ... 3) does the new Comm Agreement address the monies from those subject licenses and how to deal with them, since the revised Comm AG was entered into after the Brown suit was initiated.
I think the Licensing now being headed by Allisense and not TPL freezes Brown's recovery to only TPL's distributed share going forward; since TPL is not longer the licensing agent.
