If Judge Grewal is taking the time to issue Orders in limine and to split the trial into two separate ones, would he really then approve the MSJs? Seems a waste of his precious time to change stuff around that is going to be cancelled anyway.

Would each company now have the right to separate juries? I would think if the jury set up on 9/23 finds FOR TPL/PTSC then other company would have to decide whether to convince them that their designs differ from the other company's designs or roll the dice with a whole new jury. Or is this Judge Grewal's sole discretion? Or is it already determined by prevailing case law and protocol?
