Sir, with all due respect, i totally disagree.

1. if you put this in the hands of a jury, your side has lost the argument...and is handing the football off to a bench-warmer, ie the jury.

A jury trial, since the patents have been found to be valid, is the only way left to realize large license fees.. the only thing left would be continued nuicance fees.. and 10 cent stock

2. i would much prefer to have my destiny in my hands. not an unknown party.

no risk no gain 10 cents

3. a jury trial is not a slam dunk. lose the jury trial and you out, out, out of settling for major bucks with the remaining 400 users.

settle short of a jury verdict and there will be no big bucks.. the stock will continue to flounder.. but the BoD will continue to collect their cash.. Hmm?

4. even having a judge make the decision is risky ... how did the J-3 work for you? how did the ITC work for you?

The J3 was mutually agreed upon settlement so the patents validity could be determined with TPL influence alone, not that of a jury being influenced by the J3.. Re the ITC.. that was a lost cause before it started due to politics

5. i have never heard Lecky say he was afraid of a jury trial or that he would not go to a jury trial. what i hear him say was that he was interested in cash...cash in his pocket.

I remember Lecky saying at SHM/s that he prefered to settle rather than go to court..

6. Lecky guided this thru ...how many 17...18 ..21...everehow many... successful patent challenges. Yes, i trust him and mr O. and the damage valuation expert and our BOD to make good decisions on settlement amounts.

You can trust Lecky.. I don't and never will.. and you trust our BOD to make good decisions.. Hmm?? Otteson.. I hope he can handle this and deliver if given the chance
