At the Oral Arguments hearing several weeks ago, the "vibe" between Acer's lawyer and our's was much more friendly and cordial. If there was to be a Settlement, it would be Acer who settled.

Also, there was discussion about if the Judge sided with the Intervening Rights argument, (which it appears he did in his Ruling yesterday), Acer's liability would be half of what it would have been otherwise. Acer's exposure was to laptops, HTC's is to phones.

I'm angry about Amazon settling. Unfortunately, I suspect this is another discounted license fee, and more importantly, it makes clear to me that the mindset of our decisionmakers is that they'd far rather be embraced by the industry than feared by them. The ink hasn't even dried on the Ruling, this is an extremely disappointing signal we're sending.
