I would hope the Judge denies that motion anyway. It seems pretty flimsy to me, as pretty much ALL of our literature and documents probably reference this claim, and the instruction, I believe was that Dr. O's TESTIMONY had to be limited to the HTC microprocessors. That HTC is hanging that argument on a slide shows that language, I would hope, would be seen by the Judge as what I think it is, a desperate attempt to lay groundwork to also introduce the ITC info.
