Good question to answer from everyone. I'm relieved and at the same time, disappointed at the low #. It's lot better than a $9 million settlement without a infringement verdict from the court. We had 100 plus licenses, some of which had double digit figures, but none had the infringement announced by a court. The fact of HTC infringing 366 made me happy.
We can enforce other patents too at HTC.
More HTC products not in this case still are not covered by this damage reward.
Damage reward does not equal a license to use 366 technology.
They still own patent dues in non-US countries where we have patents.
ITC judge and staff cannot say they don't infringe anymore.
We can ban their imports and sales in US through ITC.
These are only for the leftover from one company – HTC, they are not even a big fish.
For all others, when they are face to face on a negotiation table, they cannot say 366 is invalid, neither can they say that it has never been enforced by a court. This is the first time this happen to 366. That's the most significant development happened today.
Ok, swallow this low $ is like taking a not so tasty appetizer before the main meal. We have so many fishes left to consume before the 366 end in 2015. We have to work out low ball deal (this one, Apple, etc.) to build average # up. I don't know anyone play USTA tennis league matches like me. Bad scores in the beginning often is not the end of world for a chance in playoffs. A team just need to build up scores to raise the standing up match by match, set by set, game by game. Influence of one or two bad numbers diminishes once a milestone is passed. Today is that milestone we are looking for for so long.
Who can take the task of gather everyone's input to build a list of $ rewarding items PTSC and TPL can achieve. Wish everyone to give their thinking about “What leverage do we have?” so we can translate “knowing what we own” to “What leverage do we have?”, to “what things TPL/PTSC can do using those leverages.
