..also I believe that infringement of the HTC products represented in court were 'locked in' at 2008 royalty rate.. or first movers/lower tier.. combine that with the APL license erroneously being designated a handset license.. and you get a much lower than expected license... 2008 is thru the goose... this is 2013.. If nothing else you go after every product manfacture other than handsets (who may now think the lowball precident has been set) and ask for level 4 or 5 royalties... if they balk.. file in ETex or NDoC asking for Grewal.. let's see what he'd have to say. I also strongly believe that an appeal of the ITC ID would provide much of the muscle needed to ratchet up the tier level..
