If you read the foot note 14 and the Jury had to assume that at the time of negotiation the patent would have been worth less because validity and infringement were uncertain. Might this be a reason for the mitigated damage amount off of what Prowse was stating as a reasonable royalty.

Hopefully we just see Companies start folding the litigation stand and see licensees in waves.
