I intend to attempt contact with Cliff later today. The 10Q is out, so he should be able to take a call from a shareholder (PTSC's general policy is to NOT speak with any shareholder when a filing is near).
Two things:
As pointed out by Parker, the PR yesterday was actually very positive, and the PR is what is seen by the masses.
Also, as pointed out by Laurie, an ITC decision is due NLT 10/21/13 - within 45 days of the Final Determination (9/6/13). IMO, there will probably be a positive decision to at least review the ALJ ruling in light of the NDoC victory. This upcoming date assumes no impact to the ITC time line due to the Gov't shut-down BS.
One further thought is that the pending ITC decision may have caused PTSC to hold back on an over-zealous PR or further sharing of info. Action there will almost certainly alter the landscape. Also, recall the over-zealous PR that came the summer before last after the initial, partial Markman victory. I'm under the impression that the over-zealous nature of that PR, proclaiming victory pre-maturely, had a negative impact. They may have learned from that experience.
