Perhaps/Maybe/Wishful Thinking, PTSC may have had some back door discussions with Charles Moore to provide enhanced funding of his Green Array investment. Sure, he is already getting $250k/mo Estimate for a year or two (Corrections welcome). Why would he risk offending Lecky and his monthly stipend? His own personal animosity arising out of the HTC trial and prior entanglements with Lecky.
Perhaps Moore could be convinced to switch allegiances. TPL absolutely desires to market whatever Moore is developing now and in the future. Moore is no friend of PTSC currently, but certainly understands the risk to tieing his future to Lecky. It may require creative financing and imaginative thinking for PTSC to pull this off, out-of-the-box strategic thinking PTSC is sorely lacking since inception of the Master Agreement and before.
Moore, at a minimum, could be a Kingmaker, enhance his own power, keep Lecky at bay, and provide PTSC /PDS the power to neutralize Lecky's machinations and deviousness once and for all. Moore could tip the % balance between PTSC/TPL, giving Moore a greater overall % in return for becoming a silent partner. Am sure, Moore, if anyone, would know WHO is guilty of infringement on the MMP.
Additionally, PTSC needs some strategic Swartz muscle NOW. Am sure, Swartz has "White-Boarded", multiple scenarios to exercise PTSC strategic control with a Court WIN. Well, now they have it, its now or never time. CJ is just the Messenger, don't count on any imaginative thinking from him. He's got his own safe gig going indefinately. lol
Just throwing wild thoughts out there. Outside-the-Box thinking.
PS: I would be surprised if PTSC negotiates a License prior to an ITC Appeal decision. Both sides have their individual reasons why it would not be in either interest to DO the Deal prior to an ITC Appeal announcement. It's called Leverage.
