what I have posted about recently, even in my last post, while PTSC/TPL should continue to pursue high-value (potentially) targets, the only way to overcome the obstacle of the low cost Apple license is through "volume sales".

It's Business 101 - VOLUME. If the value of your product somehow deminishes (regardless of cause, whether it be competition, market pressures or a really bad precedent having been set, as in this case), and therefore the margins decrease, the only way to overcome this difficulty is through volume sales.

This is why I am frustrated by any suggestion of actions which could in any way negatively impact the operations of Alliacense. We have two years left to notify and start the money clock. We have a win against HTC, which I believe is in essence a win against TI (and probably Qualcom and ARM). TI touts having 80,000 customers per their Web site. If PTSC/TPL could capture just a measely 1% of those customers, we'd have 800 new licensees from the TI source alone.

Small license fees? With only a two year period from notification to expiration of the '336, the fees would inherently be smaller than they were in 2006. But suppose we just get nuisance level license fee amounts from 800 licensees, say $2M a pop (perhaps half the cost of litigation, if they opted for that route). 800 new licensees. Do the numbers. And that's just TI-sourced infringers, and only 1% of their customers.

Don't mess with your engine. It runs. Perhaps not operated the way you'd (or I'd) perfer. But the race is nearly over, the white flag is visible. This is no time to make a pit stop and try to do a quick engine swap. The race will be over before you restart, or at minimum you'll be way behind where you would have been had left left the engine alone, and just monitored it and tweaked it for better performance.

And those high value targets? With every notification sent to an infringer, the pressure on their chip/chip design supplier is magnified.
