Since you focus more on licensing/settlements of IP assets, do you believe with only a favorable NDoC jury verdict PTSC/TPL would be able to factor in litigation costs to trial to create a base license for all notified infringers? For example, since it costs say 2 to 4 million to litigate to trial, PTSC/ TPL could create a base license for the aforementioned amounts? Otherwise, the odds of these companies losing at the NDoC would most like be high, therefore in this expense sensitive corporate climate, it would be easier for the large companies to just take a license for the quantity it would cost to litigate. Is the above a probable negotiating strategy? Or is there a completely different approach not considering litigation cost? Thanks for any reply.
