What I don't agree with is your [Brian's] need to embellish, as you did with the Apple license

My apologies to the board for not letting this go.. embellish connotes beyond the truth.. Brian embellished nothing wrt to the Apple license.. In the face of Leckrone ripping us off under the guise of NDA and the fact that the license was never supposed to come to light, Brian used the only means of determining the numbers that were available.. court documents from 4 diff litigations! Moore's Declaration in his litigation with TPL/DL which named Apple and stated it as "less than 20%" not just under 20% as you mistakenly quoted it, which combined with the Hoge 'Company A' document in PTSC v TPL litigation stated matching timelines and Restraining Order and mentioned one figure for the total license: $26.62M.. this document also uses the exact phrase "less than 20%".. Couple that info giving in court under penalty of perjury with the court info stated under oath by DL (which I would put at a 75% chance of actually being the truth) that the MMP portion of the Apple license was $960K (you intimated in an earlier post that Brian had kept the real mixed Apple license from us here because it had to have been revealed during the litigation, well no one else that attended said it had been made public or new what the number was and it was never in any Pacer.. my guess is TPL/PTSC had to keep it underwraps because if it was revealed in the HTC litigation just how badly DL and TPL had ripped off their partner and co-defendant it would have placed his testimony in its entirety in question and jeopardized the entire litigation as parts of his testimony were crucial to our case) ... Now add that to the Brown v TPL/DL document that stated the PTSC v TPL litigation arose "from TPL's mis-allocation of a "mixed" MMP license to a major Silicon Valley firm, allowing TPL to appropriate for itself some 95% of the gross license proceeds without accounting to its MMP partners for their rightful share of a multimillion dollar license"... Brian's assumption and statements here regarding the Apple numbers were easy to come to if not easy to dig up... they were nothing short of the truth given the info (lack of it) we get from PTSC.. and it took a phone call to Cliff to even begin to decipher just how stunningly far DL may have negotiated down that Apple license.. and even then he revealed no numbers right?? He just spun "no where near"..

.

again, my apologies to the board
