Regarding PTSC failure to seek a third member of PDS you said:

While it may be true that DL would never agree to a non biased third member, you are dead wrong in your statement that PTSC had no way to deal with DL. There has always been a provision in the PNewco Operating Agreement whereby Aribration could be used to appoint the third member. DL even commented on this provision in his Disclosure statement and wondered why Johnson never pursued this.
Any ideas as to why Johson never pursued Patriot's right to Arbitration to appoint the third member of PDS?
