As the deadline for appealing the ITC decision nears, does anyone have any thoughts on whether TPL will do so? Pros, cons of an appeal?

My feeling is that TPL needs to appeal. If they don't, I'd be willing to bet that HTC will get the ITC opinion into the CAFC. If I were TPL, I'd rather have the first word in saying how and why the ITC was wrong. Plus, a win in both the ITC and NDCA would be huge. From what I could find, the CAFC reversal rates at both the district court level and the ITC are about 33%.
