Quite right on this point, RHammer. the Mining Act states clearly that "...the holder of a mining claim does not have any right, title or claim to the surface rights of the claim other than the right to enter upon, use and occupy such part or parts thereof as are necessary for the purpose of prospecting and the efficient exploration, development and operation of the mines, minerals and mining rights therein."[sect. 50.(2)]

But what KWG has made here seems quite unique, and perhaps unprecedented (I'm no expert on this, please help!): systematically staking pieces land (for "prospection") directly on an imaginary line that would eventually become a potential -and only- route to a huge mining camp... KWW will certainly have to prove that there is prospection work done or to be done, and show some assays...

The holder of the claims will certainly a word to say when it comes to surface rights (ex: 'how can I option my staked claims to a prospective partner if the surface rights are being altered?'). But the extent of the mining claims holder power is still to be established...

All we can say for now is that Frank Smeenk is certainly a clever, daring president, and that Cliffs face is about to turn blue... Hope for KWG shareholders, is that these unusual, creative strategies will be changed into dollar signs some day! I am a believer of Frank's vision... And I'm sure there are a few master cards left by his vest! Don't we have a FN prestigious member on CCC board?
