B-Jay the natives can not form a new territory, that is out of the question mainly due to there being too few of them and too many southerners in the north but also both governments have to agree and the electorate of both won't, so fat chance. Nor can Ontario be bypassed, a jurisdictional issue is involved and mining is Ontario's not Fed's.
