It would be unwise for the Province and the Feds built a road without 'consultation'.

The issue of aboriginal rights in Canada and in perticular Treat 9, is vastly complex and will take commitments on the Feds, the Province, and aboriginal leaders to resolve in a meaningful way. For a taste of the historical complexity, I suggest a read of "Treaty Research Report - Treaty No. 9 (1905-1906)" from the website of Aboriginal Affairs and Northern Development. Its a long read, but helped me to better understand the context of the current state of affairs.
