Status of NOT vs KWG re N/S route

I sent an e-mail a while back and received a reply, basicly no news:

Ed, Thanks for your e-mail.

Regarding the disputed N-S route, there has been no resolution since the Cliffs acquisition. Cliffs had been granted an easement over the KWG claims by the Divisional Court. KWG received leave to appeal the Divisional Court ruling and submitted their arguments. That is where the matter now stands.
