Shorting is selling what you do not have with the hope that eventually you will make good on the transaction. In most other environments it is simply called 'commiting fraud',

Well, actually, it's not illegal in most contexts to sell something that you do not already own. I mean if you order a book from Amazon which they don't have on stock... they'll have to procure it themselves. What's so different about that?
