"This termination payment will not be payable if BHP elects to match the Wyloo Offer and Noront and Wyloo Metals therefore do not enter into the Arrangement Agreement."

This is a good thing actually , that we in actuality will probably never need the loan , the 17 million is only if BHP does not match, and if they dont match then we enter into the Arangment agreement with Wyloo and for that we dont pay the 17 million. 

If someone else comes in to buy they will probably pay the 17 million anyways, not NOT.
