Is there any chance that bhp can simply withdraw their offer? The scenario I'm thinking about is some backroom deal where BHP gives Twiggy something he wants in one of his other interests. BHP withdraws this offer, then later revert to an even lower offer and Twiggy then tenders while bhp gives him something on one of his green energy projects or something else. Too consiratorial? Or sound robber baron ethics.
