For clarity, BHP or Wyloo requires 2/3rds of ALL outstanding shares AND 50% of the shares they don't own or control. Although BHP/Notont board says there is a route to them winning without Wyloo's shares I don't see it.  BHP would have to get every share that Wyloo doesn't own (which isn't going to happen) and a few extras.  Wyloo's path is much clearer.
