Until the deal closes, there is always the chance that some player in the deal may pull out.  If KXL could not fill the desired subscription, they may have to then renegotiate the price.  I doubt that will be a problem with this financing, but I will not say it could not happen either.  The only other bought deal I know of that failed to close was with QGX this year, where they ended up closing just a small part of the original deal. I am sure there are others.
