Interesting wrinkle tada, thanks for sharing your take....I guess it might come down to whether or not termination is the same thing as expiration.  To my way of thinking they're two different things...but the devil is always in the details. 

It'd be nice if Resverlogix ends up with the $8 million, no doubt long ago spent in any case, without having to give up anything....with possibly being able to negotiate another ROFR with HL USA or any other interested parties, if there are any.
