To me the most important messege conveyed by the complaint filed against VIVITAR, (aside from what we have discussed so far), is the fact that DM recruited "WOODY" to be "OF COUNSEL" on this case.

Remembering the fact that this guy is a "DEFENSE COUNSEL", with a list of clients who are among the top echelons of the corporate land scape, it is incredible that he agreed to join up. DM must have made him an offer he could not refuse... 

He certainly knows that he would be affecting his ability to represent some of the 174 defendants identified by EDIG, and thus he will be loosing a great deal of "Potential business". And he certainly will not be able to represent any of the defendants against EDIG in the future after being involved in this case...

This is a great Chess Move by DM. In one move they have taken out their worst "potential enemy" out of the picture and have made him come to EDIG's side....
