It makes you wonder if Vivitar was selected as enemy #1 because their market was the smallest compared to other infringers and the possibility to negotiate a "bargain" settlement, not  unlike ptsc giving their early settlements better deals, DM felt confident Vivitar might settle if the early terms were palatable....with not that much left being on the table.
