No way they saw this coming! I think the logic of going after Vivitar, and I don't know this as fact, but I believe Vivitar represented a cross the board infringement on all our patents as well as an easy target. I'm pretty sure the CEO resigned within weeks of filing the law suit and things went south from there. It's my feeling the entire intellectual property enforcement strategy was restructured since then. It now appears that efforts to persue Vivitar in earnest may represent an exercise in futility. (blood out of a stone concept) I think the process will run it's own course without much additional resources from DM. Their time and effort are better spent directed at this next phase, which hopefully will manifest itself in the next several weeks.
