If the judge feels edig's case has no merit could he decline to schedule Markman? If he does schedule, wouldn't the other defendants want to know edig's position and gather more information before responding? The hearing to schedule the Markman is a public hearing, no?

It also makes sense that defendants would talk amongst themselves to strategize, of course.
