Now that is entirely possible. PN's investigations, the 174 reported infringers, could contain many that use EDig's IP gotten from another company. However, they are still responsible for EDig's IP usage since EDig had not sold their IP to anyone.
If these downstream IP users cannot be held responsible, which I cannot see how that could be, then any lawsuit against a company that passed downstream would certainly take their profits from those "downstreamers" into account for any settlement.
