I would suspect that both approaches are in effect. One simply could generate a quicker revenue stream and may be more acceptable to the infringer.

The question centers around whether the license agreement would include some settlement cash to cover current and past infringement.

I prefer a realistic settlement along with licensing fees which provides a continuing source of revenue.
