"(where files might not come under the patent)? Anyone?"
I previously made the comment..
"e.Digital is basically saying...make all the removable flash modules you want...we're after the device makers that implement them having an audio platform....and at this point it does not matter how the files on the removable memory are forwarded(shadowed/paged) into the audio platform. If you want to argue that point then we will move to that point."
Shadowing a file form flash(removable or static) the whole file is signaled into a RAM resource and executed from there. Theoretically a flash module could be removed and the audio will play. No infringement.
Paging a file from flash(removable or static) a continuous fixed portion of the file is signaled into a RAM resource(or high speed cache) and executed from there. In this case, the flash needs to be plugged in, in order for the continuous page to happen.
Like I have commented in the past, the easiest way to spot an infringement is to review the RAM resource(or caching scheme)...if its apparently large no infringe more than likely a shadowing process... if tiny its a paging process. This will keep them from throwing cash at dead issues.
