DM may be "looking down the pike" but I do not believe any settlement they agree on will be miniscule to the point where it hasn't even paid for their time and effort much less any profit to the company.

DM is in this for the money! ANY money coming from this first settlement should be significant and will put DM and EDIG in better position to move forward... and it wouldn't take very much.

I would view a settlement of at least 3 million to be quite favorable. More is better. Less could still be okay, but less than 1 million would be disappointing. More that 10 million would be phenomenal.
