I guess the question is...did Sakar think EDIG's IP was owned by Vivitar at the time of the sale. I doesn't make any difference if they're not using it. If they are, you can add Sakar to the list of infringers. :>) Besides, they must have had knowledge of the filing and didn't think it was material to their agreement with Vivitar.
