Good question for the legal guys in here, but my take is DM still gets 40%, but with no suit filed, the expenses handling a transaction of a company who simply gives up, and pays before being accused and FORCED to hire counsel at that point, the expenses go WAY down and more bucks hits one of RP's many bank accounts!

Seems logical to me.
