IMO, we have to bank some bucks before making a real threat.
You implied earlier that I was being ridiculously conservative - so if that's true, then they have (already or soon will) banked some bucks.
Yes, there's a threshold and no, we don't know what it is. My point was that we now have a Markman date that is only one year out against a single opponent with very deep pockets. Considering another roughly 200 infringers to go, it makes sense to push for a Markman hearing sooner than later... unless they can settle for some very serious coin.
The above assumes that we have them dead to rights and think our chances of winning at Markman are greater than 90% or more. If we have them, then why not make the threat?
Any settlement with Samsung should not IMO be for nuisance value at this point even if all the previous 6 settlements were.
