I think it means they are claiming that SAMSUNG of North America did not sell the products to American retailers but that they came via overseas shipments from another branch of SAMSUNG.
And it appears they are trying to say they did not infinge on that basis, which is hogwash, and DM states as much.
If that isn't willful infringement, I don't know what is.
