After thinking about the fact that EDIG recently requested, and was granted, dismissal of their remaining counterclaims, I don't think a settlement is in the offing. From digEcor's perspective, they have nothing to lose now. Why not roll the dice with the trial starting next Monday and perhaps convince the judge to award monetary damages or attorneys' fees. With no counterclaims to worry about, that's what I'd do.
