Ric, I have wondered about that since they filed for dismissal. Makes no sense to me, especially when considering we won most of the summary judgments to that point and certainly the most important ones.

Either they felt they couldn't win the counterclaims, were extending an olive branch to digEcor, or perhaps EDIG is trying to show the judge they are taking the high road by not wanting to punish digEcor monetarily and hoping he'll rule digEcor's claims as frivolous. Your appeal theory makes as much sense as anything else.
