If they are utilizing a strategy to seed the effort.....with as you note "nuisance settlements" IMO, it needs to happen with restraint....where, with a positive Markman opinion they then obtain a better position within the industry. If they are to do this, do it big...you have to think along the lines of putting business, out of business, if they can not afford the entry fee for the tech....upon a positive result.
