How about:

1) They have worked out a DEAL with SAMSUNG where they get "X" amount to get out of SAMSUNG to get out of samsung face righ now, OR;

2) SAMSUNG buys them out for "X+Y" after a positive Markman Ruling, in which case Samsung will be deciding the direction of any further litigation?
