"My opinion at the present time is that there will be a Markman hearing and ruling in our current case with Samsung, but, as always, we shall see.'
My opinion...don't start a fight if you're not willing to take the hurt.
I'm having a problem understanding the meaning for comments ie...
"if there is also no real controversy as to validity of the patents (another complex issue, and a very significant factor in distinguishing EDIG’s case from PTSC’s case), the trial would be held on the issue of recoverable damages alone."
"From the above, one can hopefully see why the Markman process is so important — its resulting ruling can, especially in a case in which validity is not really at issue, be the lynchpin of the entire litigation."
With that, do you feel that Samsung will not challenge the validity of the patents? I have read where data structure was challenged with a response.
"another complex issue, and a very significant factor in distinguishing EDIG’s case from PTSC’s case"
Could you expound? Perhaps that would put us on the same path...I see a challenge as a challenge ...other than the tech being different....what would make the process different between e.Digital and PTSC in determining validity?
What precisely is the problem PTSC has, that we do not want regarding its validity?
