What precisely is the problem PTSC has, that we do not want regarding its validity?

I ask that question because of this post...

and that is not the first comment I have read talking about PTSC's problem...apparently surrounding its Markman and validity issue..

What did PTSC legal do that was wrong, or what is it that we should not do in the same manner that they did?
