Thanks for the Pacer info. I see that you have already figured out that they did not settle ..took time to compile the following (without a Pacer account :-) but worth the read. I think we will know when there is indeed a settlement. BTW..this means DGX and Leica did not settle too.

I disagree with your statement of fact that Leica did not settle. Truth is we don't know. Here's what we do know as FACTS regarding the dismissals to date:

  • TIC Computer (aka Wolverine Data) was dismissed and settled with EDIG.
  • Summit Global Group, LLC was dismissed due to the wrong name. Correct company name is Summit Technology Group, LLC.
  • DXG Technology, Inc was dismissed due to the wrong name. Correct company name is DXG Technology, Corp.
  • Kyocera Wireless, Inc was dismissed due to the wrong name. Correct company name is Kyocera Wireless, Corp.
  • Leica Camera AG was dismissed. Reason unknown.

Additionally, we know that Ikegami Electronics (U.S.A.), Inc, Roland Systems Group U.S., and Roland Corp haven't been dismissed yet but have settled with EDIG. We know this because I heard Mr. Jameson tell the judge and there is a reference to the settlements in Doc 144. It is unclear why they haven't been dismissed yet but it could just be DM is dotting the i's and crossing the t's in the settlement agreements. Or there could be a grander strategy planned by EDIG to announce a barrage of settlements in a coordinated effort to get some market attention.
