Make that "there is at least 60% chance at least 10 0utof the 16 remaining defendants will settle before 30 Jul 10, and out of the reamainig 6, 5 will settle before the Marin the Markman Hearing Date, and IMATION will throw in the Towel before the Hearinf starts"...Lol...Lol...

Pretty bold statement on your part, but to back that up, and someone correct me if this is not accurate...from my memory....

There was a Markman date set for 2/17/10.

At the SHM 11/17/08 (yes 2008) in response to a question from me asking about a guess as to timing for settlements, the RP response was: "settlements before Markman." At that time, I don't think the 2/17/10 date had been set...not sure on that point? I could be mistaken, but I believe the comment of "settlements before Markman" (note settlements as in plural) was based on an assumption that at some point a date would be set in the normal course of legal wrangling.

6 went down, and Samsung was the hold out, so we all thought they were going all the way. Instead, it drug out and drug out, then settlement was in the air and we got there, but then a 30 day delay was granted to allow Samsung to "take care of obligations."

At any rate, on 10/22/09 the PR hit the wires of the settlement.

So, is Minister's bold statement far fetched?

I doubt it very much.....

To further back him up, look at the push back by DM, calling the defense out. Sounds to me all they are doing is damage control, as in minimize the pain financially and get the best deal they can get, while piling up billable hours, and justify it by reducing the cash outlay to cover the hours with some money left over for their client in the process. By this I mean, IMO, if the client could be on the hook for $5 mln, and the attorney makes $500K in defense, the settlement goes for $4 mln, the client is ahead by $500K.

A friend of mine, and I've mentioned this before, is a criminal defense attorney in San Diego with 15 years at the job. His specialty is drug offenses. When faced with a judgement of 5 years, if he gets the client 3, and makes $25K doing it, the scum bag is a happy camper. Most of his stuff are 18 - 25 year olds who parents have bucks.
