Good point, and I don't know. However, I will say this: The intent of '774 is clear! Please remember that when this patent was being put together in '94 the RFM concept was brand new, and its hard to believe every conceivable base could have been covered. Hopefully at the end of the day the patent language won't be taken as absolute and common sense will prevail.

What really worries me is that JK perceives what, for lack of a better word, potential "damage/impact" could/would have on the portable handheld industry to the benefit of this tiny little company, e.Digital, and doesn't want to be held responsible one way or the other. I think she knows it will go to trial and be off her hands. MOO.

I reckon DM will push forward simply because if it goes the way it should, it will be a landmark case. Having said that, does edig have the cash to last a year with any semblance of an on going business?
