You are right DM has total control of the litigation. If he filed a dismissal of the whole case tomorrow, and PACER was posted here, then you can make the above statement.,

For now, DM has decided to cash out as many as he can, and proceed with Tier III, where the big money is, while concurrently geting the Appeal of this BAD Un-Decision.
