Would you consider our Flash patents technically necessary patents or design patents? Design patents that can be slightly modified to make ours valueless or patents that by their nature are innovative and necessary for a process. Please excuse my ignorance on this matter, but would love to hear a short explanation. Seemingly, DM believes the latter and I averaged down primarily because of my perception of their business decision to take our case on a contingency basis. I know they did more DD and are way smarter than me. That, of course, does not make them right--I just like the odds of the bet. Bets where you are getting the best of the odds are lost all the time, but if you keep putting yourself in that position you will be sucessful in the long run.
