The uniqueness for the most recent issues challenged are in 737 in managing bad memory cells. 737 is used in the "recording medium" as well as the "Flash memory" of claims 1 and 19 to cull out and track bad memory cells. Where for the "recording medium" this is a most important feature....for this type memory would be of a more dedicated nature for contiguous data issues.

Claim 5 of 737 is all they need to introduce to prove their point of both memory types.
